Historical political entities differ in their understanding of sovereignty. This paper studies how conceptualizations of sovereignty clashed during the peace negotiations between the Spanish Monarchy and the United Provinces of the Low Countries held during the 1640s. It argues that these different understandings of sovereignty posed a significant obstacle to the signing of the peace and, once signedm remained a potential source of instability in the relationship not only between both polities but also for the internal equilibrium of the Dutch (...) Lorraine Daston ha señalado la influencia que The emergence of probability de Ian Hacking ha tenido en su trayectoria intelectual y en su elección de la etiqueta epistemología histórica para describir su trabajo. Hacking, por su parte, ha respondido a estos señalamientos que, en primer lugar, Daston y sus colegas no hacen epistemología, sino que más bien estudian conceptos epistemológicos como objetos que evolucionan y mutan; en segundo lugar, que su trabajo sobre la probabilidad no es epistemología histórica sino, en (...) todo caso, lo que él llama metaepistemología histórica o, mejor aún, ontología histórica. En el presente trabajo, analizo en qué forma entienden Daston y Hacking el tipo de investigación que denominan respectivamente epistemología y metaepistemología histórica, y exploro sus convergencias y divergencias con el fin de establecer posibles relaciones, intereses y antecedentes compartidos. Por último, sostengo que la obra de Hacking puede ser visualizada como resultado de investigaciones que caracterizan a la epistemología histórica, como consecuencia de su interés, estimulado por la lectura de Michel Foucault, en el análisis de las condiciones históricas de posibilidad para la emergencia de conceptos y objetos científicos. Así, el problema del origen de la vocación en el sujeto encuentra,desde la comprensión del sentimiento amoroso, su pleno significado. Over the last decade, Corporate Social Responsibility (CSR) has been defined first as a concept whereby companies decide voluntarily to contribute to a better society and cleaner environment and, second, as a process by which companies manage their relationship␣with stakeholders (European Commission, 2001. Nowadays, CSR has become a priority issue on governments’ agendas. This has changed governments’ capacity to act and impact on social and environmental issues in their relationship with companies, but has also affected the framework in which CSR (...) public policies are designed: governments are incorporating multi-stakeholder strategies. This article analyzes the CSR public policies in European advanced democracies, and more specifically the EU-15 countries, and provides explanatory keys on how governments have understood, designed and implemented their CSR public policies. The analysis has entailed the classification of CSR public policies taking into consideration the actor to which the governments’ policies were addressed. This approach to the analysis of CSR public policies in the EU-15 countries leads us to observe coinciding lines of action among the different countries analyzed, which has enabled us to propose a ‹four ideal’ typology model for governmental action on CSR in Europe: Partnership, Business in the Community, Sustainability, and Citizenship, and Agora. The main contribution of this article is to propose an analytical framework to analyze CSR public policies, which provide a perspective on the relationships between governments, businesses, and civil society stakeholders, and enable us to incorporate the analysis of CSR public policies into a broader approach focused on social governance. If a classical system has infinitely many degrees of freedom, its Hamiltonian quantization need not be unique up to unitary equivalence. I sketch different approaches (Hilbert space and algebraic) to understanding the content of quantum theories in light of this non‐uniqueness, and suggest that neither approach suffices to support explanatory aspirations encountered in the thermodynamic limit of quantum statistical mechanics.

Over the last decade, governments have joined other stakeholders in assuming a relevant role as drivers of CSR, working together with intergovernmental organizations and recognizing that public policies are key in encouraging a greater sense of CSR. This paper focuses on the analysis of the new strategies adopted by governments in order to promote, and encourage businesses to adopt, CSR (...) values and strategies. The research is based on the analysis of an explanatory framework, related to the development of a relational analytical framework, which tries to analyze the vision, values, strategies and roles adopted by governments, and the integration of new partnerships that governments establish in the CSR area with the private sector and social organizations. The research compares CSR initiatives and public policies in three European countries: Italy, Norway and the United Kingdom, and focuses on governmental drivers and responses. The preliminary results demonstrate that governments are incorporating a common statement and discourse on CSR, working in partnership with the private and social sectors. For governments, CSR implies the need to manage a complex set of relationships in order to develop a win–win situation between business and social organizations. However, the research also focuses on the differences between the three governments when applying CSR public policies. These divergences are based on the previous cultural and political framework, such as the welfare state typology, the organizational structures and the business and social and cultural background in each country. A normal state on a von Neumann algebra defines a countably additive probability measure over its projection lattice. The von Neumann algebras familiar from ordinary QM are algebras of all the bounded operators on a Hilbert space H, aka Type I factor von Neumann algebras. Their normal states are density operator states, and can be pure or mixed. In QFT and the thermodynamic limit of QSM, von Neumann algebras of more exotic types abound. Type III von Neumann algebras, for instance, (...) have no pure normal states; the pure states they do have fail to be countably additive. I will catalog a number of temptations to accord physical significance to non-normal states, and then give some reasons to resist these temptations: pure though they may be, non-normal states on non-Type I factor von Neumann algebras can't do the interpretive work we've come to expect from pure states on Type I factors; our best accounts of state preparation don't work for the preparation of non-normal states; there is a sense in which non-normal states fail to instantiate the laws of quantum mechanics. This paper draws on the philosophies of Maurice Merleau‐Ponty and Hannah Arendt in order to explore the nature of free action. Part one outlines three familiar ways in which we often understand the nature of freedom. Part two argues that these common understandings of freedom are rooted in impoverished conceptions of time and subjectivity. Part three engages with Arendt’s conception of natality alongside Merleau‐Ponty’s conception of expression in order to argue that the freely acting self draws in improvisational manners on (...) the resources of a shared past in order to open unprecedented spaces of meaning for the future, and in so doing at once discovers and institutes herself as the self that she is. Part four draws on an example of anti‐oppressive political action in order to argue that free action not only has the power to inaugurate new spaces of shared meaning for the future, but also to change the sens of the shared past. By the same token, free action is vulnerable in its ontological status and ethical meanings to the events and judgments of the future. Part five argues with both Merleau‐Ponty and Arendt that ethical‐political actors can do no better than to cultivate a political virtù while facing up to the inherently transgressive dimensions of free action in a shared historical world. ABSTRACT Against empiricist and rationalist prejudices concerning the nature of issues related to “mental health,” this article offers a phenomenological account of identity as developed in a meaningful system with the environment or world. Drawing on the work of Merleau-Ponty and Dewey, I argue that behavioral and emotional health and illness must be understood in terms of the plasticity or rigidity, respectively, of the individual's responses in the face of new and threatening environmental demands. However, individual plasticity and rigidity are (...) not given qualities of the individual but are themselves developed in healthy or unhealthy interpersonal environments. I discuss three cases of emotional and behavioral trouble in order to explore the manner in which unhealthy self-environment systems can undermine individuals' powers of adaptability and growth. In recent years, business ethics and economic scholars have been paying greater attention to the development of commons organizing. The latter refers to the processes by which communities of people work in common in the pursuit of the common good. In turn, this promotes commons organizational designs based on collective forms of common goods production, distribution, management and ownership. In this paper, we build on two main literature streams: the ethical approach based on the theory of the common good of (...) the firm in virtue ethics and the economic approach based on the theory of institutions for collective action developed by Ostrom’s research on common-pool resources to avert the tragedy of the commons. The latter expands to include the novel concepts of new commons, “commoning” and polycentric governance. Drawing on the analysis of what is new in these forms of organizing, we propose a comprehensive model, highlighting the integration of two sets of organizing principles—common good and collective action – and five problem-solving processes to explain the main dimensions of commons organizing. We contribute to business ethics literature by exploring the convergence between the ethical and economic approaches in the development of a commons organizing view. (shrink)

An “intrinsically mixed” state is a mixed state of a system that is ‘orthogonal’ to every pure state of that system. Although the presence of such states in the quantum theories of infinite systems is well known to those who work with such theories, intrinsically mixed states are virtually unheralded in the philosophical literature. Rob Clifton was thoroughly familiar with intrinsically mixed states. I aim here to introduce them to a wider audience—and to encourage that audience to cultivate their acquaintance (...) by suggesting that intrinsically mixed states undermine assumptions framing standard discussions of the quantum measurement problem. : Some feminist epistemologists make the radical claim that there are varieties of epistemically valid warrant that agents access only through having lived particular types of contingent history, varieties of epistemic warrant to which, moreover, the confirmation-theoretic accounts of warrant favored by some traditional epistemologists are inapplicable. I offer Aristotelian virtue as a model for warrant of this sort, and use loosely Aristotelian vocabulary to express, and begin to evaluate, a range of feminist epistemological positions.

Research with human–animal chimera raises a number of ethical concerns, especially when neural stem cells are transplanted into the brains of non-human primates . Besides animal welfare concerns and ethical issues associated with the use of embryonic stem cells, the research is also regarded as controversial from the standpoint of NHPs developing cognitive or behavioural capabilities that are regarded as “unique” to humans. However, scientists are urging to test new therapeutic approaches for neurological diseases in primate models as they better (...) mimic human physiology than all current animal models. As a response, various countries have issued reports on the topic. Our paper summarizes the ethical issues raised by research with human–animal brain chimeras and compares the relevant regulatory instruments and different recommendations issued in national reports from three important European research nations: Germany, Switzerland and the United Kingdom. We assess and discuss the focus and priorities set by the different reports, review various reasons for and perspectives on the importance of the brain in chimera research, and identify critical points in the reports that warrant further specification and debate. This is the first of a two-part introduction to some interpretive questions that arise in connection with quantum field theories (QFTs). Some of these questions are continuous with those familiar from the discussion of ordinary non-relativistic quantum mechanics (QM). For example, questions about locality can be rigorously posed and fruitfully pursued within the framework of QFT. A stark disanalogy between QFTs and ordinary QM – the former, but not the latter, typically admit infinitely many putatively physically inequivalent realizations – prompts (...) relatively novel questions, questions about how to understand and adjudicate different strategies for equipping quantum theories with content. Part I sketches the fate of locality and related notions in QFT, then documents the non-uniqueness unprecedented in ordinary QM but rampant in QFT. The current study assessed the extent to which the use of referential prosody varies with communicative demand. Speaker–listener dyads completed a referential communication task during which speakers attempted to indicate one of two color swatches (one bright, one dark) to listeners. Speakers' bright sentences were reliably higher pitched than dark sentences for ambiguous (e.g., bright red versus dark red) but not unambiguous (e.g., bright red versus dark purple) trials, suggesting that speakers produced meaningful acoustic cues to brightness when the accompanying (...) linguistic content was underspecified (e.g., “Can you get the red one?”). Listening partners reliably chose the correct corresponding swatch for ambiguous trials when lexical information was insufficient to identify the target, suggesting that listeners recruited prosody to resolve lexical ambiguity. Prosody can thus be conceptualized as a type of vocal gesture that can be recruited to resolve referential ambiguity when there is communicative demand to do so. (shrink)

We often think of normal childhood as a progressive development towards a fixed—and often tacitly individualistic and masculine—model of what it is to be an adult. By contrast, phenomenologists, psychoanalysts, sociology of childhood, and feminist thinkers have set out to offer richer accounts both of childhood development and of mature existence. This paper draws on accounts of childhood development from phenomenologist Maurice Merleau-Ponty and object relations theorist D. W. Winnicott in order to argue that childhood development takes place in “transitional (...) spaces”; explores typical gendered patterns in the formation of selfhood that “split” relationality and separateness into the “feminine” and the “masculine”; and offers a phenomenology of perception, love, and objectivity in order to show the manner in which, contra individualistic and masculine visions of adulthood, maturity requires an embrace rather than eschewal of ambiguity, and the capacity to continue to dwell in the transitional space between relatedness and separateness. In 2010, Connecticut implemented an offence prohibiting minors from engaging in sexting. This legislation was part of a range of reforms across the United States aiming to better tailor the criminal law’s response to youth sexting by distinguishing sexting from child abuse material. Drawing from submissions to the Connecticut General Assembly’s Sexting Bill, media reports and recent ‘sexting’ cases, this article adopts a feminist perspective and examines the justifications for and implications of this sexting statute. It argues that while aiming (...) to create a distinction between child abuse material and sexting through a ‘lesser’ offence, these paternalistic reforms are informed by some of the same logics shaping child pornography/child abuse material law. Therefore, this statute is situated on a continuum of paternalistic legislation which utilises the constitutive expressive function of the criminal law to register anxieties about young people’s sexual and technological practices. As a result, this statute conflates victims and perpetrators of image based sexual abuses and fails to meet its deterrent and protective aims. (shrink)

Van Fraassen's 1991 modal interpretation of Quantum Mechanics offers accounts of measurement and state preparation. I argue that both accounts overlook a class of interactions I call General Unitary Measurements, or GUMs. Ironically, GUMs are significant for van Fraassen's account of measurement because they challenge it, and significant for his account of preparation because they simplify it. Van Fraassen's oversight prompts a question about modal interpretations: developed to account for ideal measurement outcomes, can they consistently account as well for the (...) whole horizon of laboratory practices by which we investigate QM? Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers. PRWORA's policies and (...) their accompanying discourses simultaneously reproduce and undermine gender hierarchy yet tacitly maintain structural race and class inequalities. (shrink)

Nancy Tuana holds that the nature/nurture dichotomy does not accurately represent the world and hence that a whole series of assumptions about human nature is mistaken. She rejects both biological determinism and alternative interactionist views. I argue that although her arguments and political concerns do rule out any kind of simple biological determinism, they do not show that the alternative interactionist view is untenable: in fact, she uses the distinction in her attempt to demolish it. I argue that the assumption (...) that "nature" implies fixity is the source of difficulties here, not the dichotomy itself. (shrink)

It has been suggested that the Modal Interpretation of Quantum Mechanics (QM) is "incomplete" if it lacks a dynamics for possessed values. I argue that this is only one of two possible attitudes one might adopt toward a Modal Interpretation without dynamics. According to the other attitude, such an interpretation is a complete interpretation of QM as standardly formulated, an interpretation whose innovation is to attempt to make sense of the quantum realm without the expedient of novel physics. Then I (...) explain why this attitude, though available, is unattractive. Without dynamics, the Modal Interpretation vanquishes the measurement problem only, it seems, to succumb to the problem of state preparation. On this view, the Modal Interpretation needs dynamics not to be an interpretation at all, but to be an adequate one. I review reasons to suspect that the dynamics which would best suit the Modal Interpretation--a dynamics equivalent to a set of two time transition probabilities of the sort used to solve the preparation problem--is not a dynamics the interpretation can have. I close with a brief discussion of versions of the Modal Interpretation that may not succumb to the considerations presented here. (shrink)

In a working note to The Visible and the Invisible, Maurice Merleau-Ponty makes an enigmatic call for “a psychoanalysis of Nature.” This paper argues that there are two interrelated ways in which this call might be taken up. First, it might be taken as the demand to give voice to the deep sense of a nature, conceived in terms of unconscious desire rather than scientific rationality, that precedes and exceeds human life. Second, we might do a psychoanalysis of our relationship (...) to nature, of the ways in which modern thought tends to deny and repress the unconscious, organic desire at its heart. This paper addresses the psychoanalysis of nature in both these senses. The first part of this paper takes up Merleau-Ponty’s well-known discussion of the phantom limb in Phenomenology of Perception in order to give a critique the mind-body dualism implicit in traditional attempts to account for this and related phenomena, and in order to present Merleau-Ponty’s own account of the phantom limb in terms of being in the world. Second, I argue that being in the world requires that we repress not only aspects of our personal pasts, but also our organic nature itself. Third, I argue that much of modern scientific thinking tends to deny the bodily and unconscious dimensions of conscious life—it is this denial that calls for a psychoanalysis in the second sense of studying our troubled and repressive relationship to nature. This denial of our own naturalness is accompanied by a denial of the unconscious and irrational nature of nature itself; finally, I will speak to the ways in which psychoanalysis might go further back than we might expect—beyond our childhoods and to the organic heartbeat of life itself. The demonstrated power of human genetic information has moved the issue of its “ownership” from the realm of musty academic musings to (...) protracted political and legal battles among “source” individuals, researchers, commercial concerns, government agencies, and others. Whether collected through targeted scientific studies, “discarded” biological tissue, initial charitable bequest, or other means, genetic information and the biological materials in which it is contained have become the subject of protracted legal battles for control and intense social and ethical controversy. The international organic agricultureand fair trade movements represent importantchallenges to the ecologically and sociallydestructive relations that characterize the globalagro-food system. Both movements critique conventionalagricultural production and consumption patterns andseek to create a more sustainable world agro-foodsystem. The international organic movement focuses onre-embedding crop and livestock production in ``naturalprocesses,'' encouraging trade in agriculturalcommodities produced under certified organicconditions and processed goods derived from thesecommodities. For its part, the fair trade movementfosters the re-embedding of international commodityproduction and distribution in ``equitable socialrelations,'' developing a (...) more stable and advantageoussystem of trade for agricultural and non-agriculturalgoods produced under favorable social andenvironmental conditions. The international market forboth organic and fair trade products has grownimpressively in recent years. Yet the success of thesemovements is perhaps better judged by their ability tochallenge the abstract capitalist relations that fuelexploitation in the global agro-food system. While theorganic movement currently goes further in revealingthe ecological conditions of production and the fairtrade movement goes further in revealing the socialconditions of production, there are signs that the twomovements are forging a common ground in definingminimum social and environmental requirements. I arguefrom a theoretical and empirical basis that what makesfair trade a more effective oppositional movement isits focus on the relations of agro-food trade anddistribution. By demystifying global relations ofexchange and challenging market competitiveness basedsolely on price, the fair trade movement creates aprogressive opening for bridging the wideningNorth/South divide and for wresting control of theagro-food system away from oligopolistic transnationalcorporations infamous for their socially andenvironmentally destructive business practices. The passage of the Servicemen’s Readjustment Act of 1944 — or GI Bill — opened up a dialogue about men’s physical and mental health, for it addressed very directly what ordinary men would need to recover from extraordinary violence. Political leaders identified veterans’ “welfare,” by which they meant general well-being, as a top priority of World War II’s recovery, and the GI Bill was the centerpiece of their agenda. The bill’s passage was an impressive legislative triumph, the collective product of (...) massive medical, legal, and social science research, bipartisan politicking, and veterans’ activism. It provided education, housing, and small business assistance, along with mental and physical rehabilitation in government-funded hospitals. All of these programs, whether they served mind, body, or wallet, amounted to welfare — a set of government-sponsored policies and services designed to aid a soldier’s transition from enlisted man to healthy, productive citizen. Thus we have to think about the broad reach of the GI Bill’s welfare provision as one of the health legacies of World War II. (shrink)

One major assumption in the climate change debate is that because respondents report positive attitudes to the environment and to low carbon lifestyles they will subsequently engage in environmentally friendly/low carbon behaviors when given the right guidance or information. Many governmental agencies have based their climate change strategy on this basic assumption, despite some anxiety about the value-action gap in psychology more generally. Here we test this assumption. We investigated the relationship between explicit and implicit attitudes to carbon footprint, and (...) both self-reports of environmental behavior and low carbon behavioral choices. We found that self-reported attitudes to carbon footprint were significantly associated only with self-reported environmental and self-reported low-carbon behaviors. They were not significantly associated with the choice of low carbon alternatives in a simulated shopping task. Given that the vast majority of studies on attitudes and behavior in the environmental domain use self-report measures of behavior, this may mean that we are generating research findings that could be making policy makers overly complacent about our readiness for actual behavior change. Implicit attitudes were not significantly associated with either measure in terms of group comparisons, but those with a strong positive implicit attitude towards low carbon did choose more low carbon items, but only under time pressure. The opposite trend was found for explicit attitudes – this increased only when participants were not under time pressure. These results suggest that Kahneman’s hypothesis about contrasting systems of human cognition might be highly relevant to the domain of climate change and behavioral adaptation. (shrink)
